Privacy Policy

Your privacy is important to us at Fox Valley Lutheran High School (“FVL”) and we are committed to protecting the privacy of and seek to provide a safe and secure experience for our users. We developed this Privacy Policy so you know how we treat, collect, use, disclose, transfer and store your information when using the FVL Application (as defined below). This Privacy Policy also incorporates by reference the Terms of Use for the FVL Application.

By using the FVL Application, you explicitly accept, without limitation or qualification, the collection, use and disclosure of personal information provided by you in the manner described in this Privacy Policy. Please read through this Privacy Policy to familiarize yourself with our privacy practices. If you disagree with the way we collect and process personal information, do not use the FVL Application. If you have any questions, please let us know by emailing us at CommunicationsOffice@fvlhs.org or by sending us a letter to the address set forth at the end of this Privacy Policy.

1. Definitions.

a. “FVL Application” means the FVL Application, including without limitation any files, images incorporated in or generated by the FVL Application, and data accompanying the FVL Application which you download.

b. “Other Information” means any information that does not reveal your specific identity or does not directly relate to an individual, such as information regarding your mobile device, such as your device identifier and IP address, as well as the website and content you have accessed, clicked or interacted with through your device.

c. “Personal Information” means information that identifies you as an individual.

d. “We”, “us” or “our” mean and refer to FVL.

e. “You, “your” and “user(s)” mean and refer to all individuals and/or entities who are accessing or using the FVL Application for any reason.

2. Collection and Use of Information.

a. Personal Information. When you create an account through the FVL Application, we may collect a variety of Personal Information, which depending on the circumstances may include your name, mailing address, telephone number, email address, school identification numbers and other personally-identifying information. We may use Personal Information about you for the following purposes:

1. Communications. We may communicate with you, such as to provide you with the services you request, to communicate with you about your account, to give you important information about the FVL Applications, and to provide you with general announcements, such as information regarding athletic events and early dismissals.

2. Support. When you interact with our support representatives via email, telephone or in person, we may collect Personal Information relevant to the situation and/or to properly identify the user. We use this information to provide you with support for the FVL Application.

b. Other Information. Please note we may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use it as described in “Personal Information” section above, as well as for all the purposes for which we use and disclose Personal Information. In some instances, we may combine Other Information with Personal Information. If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.

c. Use of FVL Application. When you download and use the FVL Application, we and our service providers may track and collect application usage data, statistics and user behavior, such as the date and time the FVL Application accesses our servers and other general information regarding page views, unique sessions, downloads, top days and visit duration.

d. Children’s Privacy. Personal information about children who are under 13 years of age is not knowingly or intentionally collected. If you are under the age of 13 years, you are not permitted to register an account on the FVL Application.

3. Disclosure of Information.

a. Service Providers. We may use third party service providers to help us operate the FVL Application on our behalf. We may share Personal Information about you with these third parties to enable them to perform the services.

b. Other Disclosures. We may disclose Personal Information about you to others if we have your consent to do so in such form of consent as may be required under applicable law. We may also disclose Personal Information about you to others as we believe to be necessary or appropriate: (a) under applicable law or regulation; (b) to comply with legal process; (c) to respond to requests from public authorities and law enforcement officials; (d) to enforce any of our terms and conditions or policies; (e) to protect the rights, privacy, safety or property of FVL, you, or others; or (f) to permit us to pursue available remedies or limit the damages that we may sustain.

4. Voluntarily Sharing Your Location Information with Others.

You might have an opportunity to choose to use a third party application on your device that allows you to invite third parties to view your location. If you choose to use such an application, then you should use caution when determining to whom you want to make your location information available. If you choose to post an invitation to view your location information on third party social networks, then, depending on the privacy practices of those social networks, it is possible that persons in addition to those to whom you intended to invite to view your location information could have access to such information. Accordingly, you should use caution when making such an invitation via third party social networks and you should carefully review the privacy practices of such social networks.

5. Links, Third Party Applications, and Third Parties’ Privacy Practices.

The FVL Application may contain links to other sites that are not operated by FVL. These linked applications are not under FVL's control and FVL is not responsible for the privacy practices or the content of any linked sites, services, and applications. If you provide any Personal Information through any third-party sites, services, or applications, your transaction will occur on the third party's site, service, and/or application and the information you provide will be collected by, and controlled by, the privacy policy of that third party. FVL IS NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF THIRD-PARTY WEB SITES OR THIRD-PARTY APPLICATIONS. We recommend you review the Privacy Policy of any third parties.

6. Security.

FVL takes reasonable security measures to help protect against loss, misuse, unauthorized access, and unauthorized disclosure or alteration of the Personal Information under its control. The transmission of information you provide to FVL during the registration processes is encrypted using secure socket layer technology (SSL). If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us of the problem by contacting us in accordance with Paragraph 9 below.

Also, if you create an account with FVL, your account information and profile are password protected. We recommend that you do not divulge your password to anyone. Our personnel will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail. Remember to sign out of your account and shutdown the FVL Application when you have finished your session. This is to help ensure that others cannot access your personal information.

No data transmission over the Internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we try to protect your personal information, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.

7. Updates to this Privacy Policy.

We may change this Privacy Policy from time to time as technologies and laws change. You can determine when this Privacy Policy was last revised by referring to the "LAST UPDATED" legend at the top of this page. Any changes will become effective upon our posting of the revised Privacy Policy on the FVL Application. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent. This notice may be provided by email, by posting notice of the changes on the FVL Application or by other means prior to the change becoming effective, consistent with applicable laws.

8. Retention of Personal Information.

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

9. Reviewing/Correcting/Updating/Deleting Information; Data Integrity.

FVL takes reasonable steps to ensure that the Personal Information we collect from you is accurate, complete, and current. You may request access and request that erroneous or inaccurate Personal Information be updated. You may also request that your Personal Information be deleted. Consistent with applicable law, FVL will respond promptly to your requests and in any event within thirty (30) days. For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We may decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause us to take any action that is not permissible under applicable laws. Please note that we may need to retain certain information for recordkeeping purposes, and there may also be residual information that will remain in our databases and other records, which will not be removed.
